Welcome to Get Radio Airplay ("Get Radio Airplay", "we", "us", "our"). These Terms & Conditions govern your use of our website and services.

By creating an account, uploading music, or purchasing a service, you agree to these Terms.

1. About Get Radio Airplay

Get Radio Airplay is a music submission platform that allows independent artists to:

Upload music for radio consideration
Purchase submission packages
Request a Radio Ready Check
Request an Independent Airplay Report

Get Radio Airplay is not a broadcaster. We facilitate introductions between artists and radio presenters.

We do not guarantee airplay.

2. Eligibility

You must:

Be at least 18 years old, or
Have permission from a parent/guardian if under 18

You must have authority to upload the content you submit.

3. Account Responsibility

You are responsible for:

Maintaining the confidentiality of your account
All activity under your login
Providing accurate information

We may suspend or terminate accounts that breach these Terms.

4. Services Provided

4.1 Radio Ready Check

A professional assessment of whether your track appears suitable for radio broadcast.

This service:

Does not guarantee airplay
Does not constitute legal advice
Reflects our professional opinion only

4.2 Song Upload Package

Submission of your track to selected radio presenters and stations.

We:

Curate appropriate contacts
Distribute your track for consideration

We do not control editorial decisions.

4.3 Independent Airplay Report

Where selected, we will arrange for independent monitoring to track potential radio airplay.

We do not guarantee:

Specific numbers of plays
Geographic reach
Station size

5. Payments & Refunds

All payments are:

Processed securely via third-party payment providers
Due in full at the time of purchase

Refund Policy

Because services begin upon submission or review:

Payments are non-refundable once work has commenced
If a technical error prevents delivery, we will investigate and resolve appropriately

We reserve the right to refuse service.

5.1 Promotional Codes

From time to time we may issue promotional codes giving a discount on the Song Upload Package or the Song Upload & Independent Airplay Report Package. Unless we state otherwise when the code is issued:

each code may be redeemed once per person;
a code cannot be used in conjunction with any other offer or promotional code;
a code has no cash value and cannot be exchanged for cash;
we may withdraw, suspend or vary a code at any time, including where we reasonably suspect abuse;
codes do not apply to Radio Ready Check purchases;
if a purchase made with a code is refunded, the code is not reinstated for that customer.

6. Upload Requirements & Content Standards

By uploading content ("Content"), you confirm:

6.1 Rights & Ownership

You:

Own or control all rights in the recording and underlying composition
Have permission for all samples, artwork, featured artists
Have the legal right to distribute the Content

6.2 Radio Suitability

Your upload must be suitable for UK radio broadcast.

Content must not contain:

Swearing or explicit language (unless provided as a clean radio edit)
Offensive or discriminatory language
Sexually explicit material
Content promoting violence, hate, harassment, or discrimination
Content promoting illegal activity (including drug dealing or incitement)
Defamatory material
Material that could place radio presenters or stations at legal or regulatory risk

If your track contains explicit content, you must upload a clean radio edit only.

7. Licence Granted to Get Radio Airplay

You retain ownership of your Content.

By uploading, you grant Get Radio Airplay a non-exclusive, worldwide, royalty-free licence to:

Host and store your Content
Process and format it for distribution
Share it with radio presenters, producers, and stations for airplay consideration

This licence exists solely for operating the service.

8. Moderation & Removal

We may:

Reject
Remove
Suspend
Refuse distribution

of any Content that breaches these Terms or may expose radio partners to risk.

We are not obliged to provide detailed reasoning.

9. No Guarantee of Airplay

Get Radio Airplay does not guarantee:

Airplay
Playlist inclusion
Reviews
Coverage
Feedback

All editorial decisions are made independently by radio presenters and stations.

10. Limitation of Liability

To the fullest extent permitted by law:

Get Radio Airplay is not liable for indirect or consequential loss
We are not liable for lost profits, reputation damage, or missed opportunities
Our total liability shall not exceed the amount paid for the relevant service

Nothing excludes liability for:

Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation

Nothing in these Terms limits or affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

11. Indemnity

You agree to indemnify and hold harmless Get Radio Airplay against any claims, damages, costs, or legal fees arising from:

Breach of these Terms
Copyright infringement
Defamatory or unlawful content
Failure to hold necessary rights

This clause survives termination.

12. Intellectual Property

The Get Radio Airplay brand, logo, and website content remain our property.

You may not copy, reproduce, or misuse our branding without permission.

13. Termination

We may suspend or terminate access if:

You breach these Terms
You upload prohibited content
You misuse the platform

Termination does not affect accrued rights or obligations.

14. Data Protection

We process personal data in accordance with UK GDPR and our Privacy Policy.

We do not sell your personal data.

15. Third-Party Services

We use third-party providers for:

Payment processing
Hosting
Email distribution
Airplay monitoring

We are not responsible for failures of third-party systems.

16. Changes to These Terms

We may update these Terms from time to time.

Continued use of Get Radio Airplay after updates constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Upload Terms

1. What these Upload Terms cover

These Upload Terms apply when you upload audio, artwork, metadata, lyrics, and any other materials ("Content") to Get Radio Airplay ("Get Radio Airplay", "we", "us").

2. You keep ownership

You retain ownership of your Content. Nothing in these Upload Terms transfers ownership to Get Radio Airplay.

3. Permission you give Get Radio Airplay (so we can run the service)

By uploading Content, you grant Get Radio Airplay a non-exclusive, worldwide, royalty-free licence to:

host and store your Content,
process it (e.g., format checks, normalisation checks, generating previews), and
share/transmit it to radio presenters, producers, and stations (our "Radio Partners") for the purpose of consideration for airplay and related coverage.

4. Your promises (warranties)

By uploading Content, you confirm and warrant that:

A. You have the rights

You own, control, or have permission for all rights needed to upload and distribute the recording and underlying composition (including samples, interpolations, beats, artwork, and featured performers).

B. It's "radio-safe"

Your upload must be suitable for radio broadcast and must not include content that could place radio presenters or stations at regulatory, legal, or reputational risk. This includes (without limitation):

Swearing / explicit language (including slurs) or offensive language
content that is obscene, sexually explicit, or unlawful
content that promotes or glamorises violence, hate, discrimination, or harassment
content that promotes illegal activity (e.g., drug dealing) or incites harm
defamatory or privacy-invading content (e.g., naming private individuals in an accusing way)

C. Clean edit only (important)

If your track contains any explicit/offensive language in any version, you must upload a clean radio edit only (or your upload may be rejected/removed).

5. What we can do (moderation + removal)

We may review, reject, remove, or disable access to any upload at our discretion, including where we believe it breaches these Upload Terms or could expose Radio Partners to risk.

6. No guarantees

Get Radio Airplay does not guarantee airplay, playlisting, or coverage. Decisions to play a track are always made by Radio Partners.

7. Your responsibility if something goes wrong (indemnity)

If your upload breaches these Upload Terms (including rights issues or unlawful content) and that causes claims or costs for Get Radio Airplay or our Radio Partners, you agree to cover those losses and reasonable legal fees.

8. Removing your track

You can request deletion of your Content from Get Radio Airplay systems. However, if your Content has already been shared with Radio Partners, we cannot guarantee deletion from their systems.
